Terms & Conditions of Service

1. Scope & Operator Partnership

These Terms and Conditions govern the provision of high-speed telecommunications services, including 5G mobile data (eSIM and physical SIM cards), symmetrical FTTH optical fibre broadband, and associated hardware provided by SolFi Telecom Iberia, S.L. (“SolFi”, “we”, “us”).

SolFi provides mobile connectivity and broadband access across the Kingdom of Spain as an authorized retail partner utilizing the Tier-1 underlying network infrastructure of licensed Spanish operators (Movistar and Orange Spain backbone networks), licensed and supervised by the Spanish National Markets and Competition Commission (Comisión Nacional de los Mercados y la Competencia — CNMC).

2. Subscriber Identity Registration (Spanish Law 25/2007)

In accordance with Spanish Law 25/2007, of October 18, on data retention for electronic communications, activation of any telecommunications line (eSIM or physical SIM) in Spain is subject to compulsory user identity registration prior to line assignment.

• Subscribers must provide a valid official passport, Spanish NIE, Spanish DNI, or EU National Identity Card.
• You warrant that all submitted documents and titular information are accurate, authentic, and belong to you.
• Under regulatory anti-fraud rules, each titular subscriber may hold a maximum allocation of up to five (5) concurrent mobile lines.

3. Billing Cycles, Pricing & Commitment Periods

All prices are transparently displayed in Euros (€) and include 21% Spanish Value Added Tax (IVA).

• 5G Mobile Data Plans (Sin Permanencia): Billed every 30 days in advance via credit card, debit card, Apple Pay, or Google Pay. You may pause or cancel your subscription at any time with zero penalty or lock-in fee prior to the renewal date.
• Home Fibre Broadband (12-Month Permanencia): Home Fibre broadband connections include a 12-month minimum commitment period (compromiso de permanencia de 12 meses). This commitment is linked to the waiver of professional optical technician installation fees and the provision of high-performance Wi-Fi 6 router hardware at zero equipment cost. Relocations within Spain are transferred free of charge. In the event of early termination before 12 months, a pro-rated installation recovery fee is billed in proportion to the remaining unfulfilled months.
• 30-Day Prepaid Passes: A one-time non-recurring payment that provides high-speed data for 30 calendar days without automated renewal.
• Bundle Discount: Combining a Home Fibre connection with active mobile lines grants an automatic 10% monthly discount on all associated mobile lines for the duration of the joint active service.

4. Statutory Right of Withdrawal (14-Day Guarantee)

Pursuant to Article 102 of the Spanish Royal Legislative Decree 1/2007 (General Consumer Defense Law) and Directive 2011/83/EU of the European Parliament and of the Council, consumers purchasing services online have the right to withdraw from the contract within fourteen (14) calendar days from the date of initial purchase without penalty and without giving any reason, provided data allowances have not been fully consumed.

5. Delivery, Installation & Service Activation

• eSIM Profiles: Delivered electronically in under 60 seconds via email and accessible inside your subscriber dashboard upon identity confirmation.
• Physical SIM Cards: Dispatched via tracked express courier (Correos Express) within 24 to 48 business hours across peninsular Spain and the Balearic/Canary Islands.
• Home Fibre Broadband: Subject to physical building coverage verification. An authorized optical technician appointment is scheduled within 48 to 72 business hours. Optical installation and Wi-Fi 6 router hardware are included free of charge with active subscriptions.

6. EU Roaming & Fair Use Policy

In accordance with European Union “Roam Like at Home” regulations (Regulation EU 2022/612), SolFi mobile plans include dedicated EU/EEA roaming allowances at no additional cost. Usage in excess of included roaming allowances or prolonged continuous presence outside Spain exceeding 4 consecutive months may be subject to standard EU regulated roaming surcharges.

7. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Spain. Any disputes arising in connection with these terms shall be submitted to the competent courts of Oviedo, Asturias, Spain, without prejudice to statutory mandatory consumer rights under the European Online Dispute Resolution platform (ODR Platform pursuant to Regulation EU 524/2013).
